Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The situation stems from a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
